Time Period For Bringing A Wrongful Death Claim

Generally speaking, you will have two years from the date of your family member's death to bring the wrongful death claim.  

Time Period For Bringing An Estate Claim

The time period for bringing an estate claim depends on whether your family member's estate is represented.  If your family member's estate is represented, then the estate has two years from the date of representation to bring an estate claim.

If your family member died without a will and an administrator has to be appointed to represent the estate of your family member, then the estate will have two years from the date the administrator was appointed to represent the estate.  

The statute of limitations is tolled for up to five years for the time period between the date of death and the appointment of an administrator to represent the estate.
