A UPS Truck Pulled Out In Front Of Me In Social Circle, Georgia And I Rear-Ended The UPS Truck. Can I Sue UPS?

The Georgia Commercial Driver Manual provides comprehensive instructions and guidance for truck drivers in Georgia.

Section 2.7.7 of the Georgia Commercial Driver Manual states the following:

“Be aware of the size and weight of your vehicle when you cross or enter traffic. Here are some important things to keep in mind.

“Because of slow acceleration and the space large vehicles require, you may need a much larger gap to enter traffic than you would in a car.

“Before you start across a road, make sure you can get all the way across before traffic reaches you.”

Because of the size and slow acceleration of UPS trucks, UPS truck drivers need to allow proper space between the UPS truck and oncoming vehicles when making turns to enter the roadways.  Failure to do this can cause rear-end accidents where the UPS truck is rear-ended by an oncoming car.

OCGA 40-6-73

The Georgia Code section on vehicles entering roadways is OCGA 40-6-73, which states the following:

“The driver of a vehicle about to enter or cross a roadway from any place other than another roadway shall yield the right of way to all vehicles approaching on the roadway to be entered or crossed.”

In short, all vehicles in Georgia have to yield the right of way to approaching vehicles before entering the roadways.  If a UPS truck fails to do this, and you rear-end the UPS truck, UPS is at fault.
