OCGA 40-6-73
Georgia has a statute that governs this type of situation-OCGA 40-6-73-which is titled “Vehicle Entering Roadway.” Please see below the statute:
The driver of a vehicle about to enter or cross a roadway from any place other than another roadway shall yield the right of way to all vehicles approaching on the roadway to be entered or crossed.
To put it simply, when cars are trying to turn onto roads and highways, they must yield the right of way to oncoming cars.
If the car you rear-ended failed to yield the right of way by pulling out in front of you without giving you time to slow down, then the other driver was in violation of OCGA 40-6-73.
If you were also driving the speed limit leading up to impact, that is even stronger evidence that the car you rear-ended failed to yield the right of way.
